Terms & Conditions

§1 Scope

These Terms & Conditions apply to all orders placed in the online shop of A.S.P – Stefan Kühberger, Oberhörnbach 18, 4352 Klam, Austria (contact details see Imprint).

§2 Conclusion of contract

The products shown in the shop do not constitute a binding offer, but an invitation to order. By submitting an order, the customer makes a binding offer to purchase. The contract is concluded once we send an order confirmation by email, or once the goods are shipped.

§3 Prices & payment terms

All prices are in euros. For shipments within the EU, prices include statutory Austrian VAT (currently 20 %). For shipments outside the EU, no Austrian VAT is charged; any import duties in the destination country are borne by the customer.

Payment is available via:

• Card / other methods via the payment provider Stripe
• Bank transfer in advance, with a 2 % discount on the goods value (details see Shipping & Payment)

§4 Delivery

Delivery times and shipping costs are listed on the Shipping & Payment page. Deviating lead times for individual products are noted in the respective product description. Goods remain our property until paid in full.

§5 Right of withdrawal

Consumers have a statutory right of withdrawal. Details and the model withdrawal form are available on our withdrawal page.

§6 Warranty

Statutory warranty applies. Consumers are entitled to a warranty period of two years from delivery of the goods. Legitimate defects entitle the customer to repair, replacement, price reduction, or rescission per statutory provisions.

§7 Liability

We are liable in accordance with statutory provisions. Liability for slight negligence is excluded to the extent legally permitted. Tuning-oriented parts (e.g. racing gearboxes, reinforced clutch components) are intended for use on vehicles not requiring road-legal certification, or on appropriately certified vehicles; the customer is solely responsible for the legal permissibility of installation in their respective country of use.

§8 Governing law & jurisdiction

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, the mandatory provisions of the law of their habitual residence apply where more favorable to them. For merchants, the competent court at A.S.P's registered seat has jurisdiction.

§9 Online dispute resolution

The European Commission provides a platform for online dispute resolution (ODR): ec.europa.eu/consumers/odr. We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board, but are happy to receive complaints directly.
